1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Team Kenya AMS App (“Application”, “Platform”).

By accessing or using this Application, you agree to be bound by these Terms. If you do not agree, you must not use the Application.

2. About the Application

The Application is an Athlete Management System (AMS) platform designed to support:

  • Athlete performance tracking
  • Training and competition management
  • Medical and injury monitoring
  • Communication between stakeholders

The platform is operated by the National Olympic Committee of Kenya for authorized users only.

3. Eligibility

To use this Application:

  • You must be an authorized user (athlete, coach, medical staff, or administrator)
  • You must be registered through a recognized sports federation or organization
  • You must provide accurate and complete information

For users under 18, access must be granted through a governing body or guardian where applicable.

4. User Accounts

4.1 Account Creation

  • Accounts are created and managed by authorized administrators
  • You are responsible for maintaining the confidentiality of your login credentials

4.2 Account Responsibility

You agree to:

  • Use the platform only for authorized purposes
  • Notify administrators of any unauthorized access
  • Ensure your account information is accurate and up to date

5. Acceptable Use

You agree NOT to:

  • Use the platform for unlawful purposes
  • Upload false, misleading, or harmful information
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with the platform’s functionality or security
  • Misuse athlete or medical data

6. Athlete and Medical Data

The platform may process sensitive data including:

  • Athlete performance metrics
  • Injury and medical records

By using the Application:

  • You acknowledge that such data is necessary for athlete management
  • You consent to its use by authorized personnel only
  • You agree not to misuse or disclose such data without authorization

7. Data Privacy

Your use of the Application is also governed by our Privacy Policy.

We are committed to protecting your data in compliance with the Kenya Data Protection Act (2019).

8. Intellectual Property

All content within the Application, including:

  • Software
  • Design
  • Logos
  • Data structures

is the property of the National Olympic Committee of Kenya or its licensors.

You may not:

  • Copy, modify, or distribute the platform
  • Reverse-engineer or exploit system components

9. System Availability

We strive to ensure continuous availability but do not guarantee that the Application will be:

  • Uninterrupted
  • Error-free
  • Free from delays or outages

We reserve the right to:

  • Perform maintenance
  • Update features
  • Suspend access temporarily

10. Third-Party Services

The Application may integrate with third-party services such as:

  • Cloud hosting providers
  • Wearable devices
  • Analytics tools

We are not responsible for third-party service performance or policies.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for data loss caused by external factors
  • Use of the Application is at your own risk

12. Indemnification

You agree to indemnify and hold harmless the National Olympic Committee of Kenya from any claims, damages, or liabilities arising from:

  • Misuse of the Application
  • Violation of these Terms
  • Unauthorized data access

13. Suspension and Termination

We reserve the right to:

  • Suspend or terminate accounts
  • Restrict access

If:

  • Terms are violated
  • Suspicious or unauthorized activity is detected

14. Data Retention and Deletion

Data is retained:

  • As long as necessary for operational purposes
  • In compliance with legal obligations

We may delete or anonymize data when no longer required.

15. Modifications to the Terms

We may update these Terms from time to time.

Updates will be:

  • Published within the Application
  • Communicated where necessary

Continued use of the Application constitutes acceptance of updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of Kenya.

17. Dispute Resolution

Any disputes arising from these Terms shall be resolved:

  • Through Kenyan courts where necessary
